Can't I just file a Claim of Exemption?
You may choose to file a claim of exemption. The disadvantage is that during the often weeks-long wait before your court date, your employer will continue to withhold 25% of your wages and send them to the levying officer. If the judge grants your claim of exemption or lowers the garnishment amount, it will still take about another month after the hearing for any excess amounts to be returned to you. In addition, any costs we incur in opposing the claim of exemption will be added on to the judgment. We prefer that you contact us first to request a modification rather than file a claim of exemption.
